Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and [FuelExpress LLC — confirm exact legal entity name and state of formation before publishing] ("FuelExpress," "we," "us," or "our") governing your access to and use of the FuelExpress mobile apps, website, and on-demand fuel delivery service (together, the "Service"). By creating an account, placing an order, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By placing an order you represent that you are the owner of the vehicle(s) being fueled, or that you have the owner's permission to authorize fuel delivery to that vehicle, and that you have lawful access to the delivery location.

2. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@fuelexpressnwa.com if you suspect unauthorized use of your account.

3. The Service

FuelExpress connects you with drivers who deliver gasoline or diesel fuel directly to a vehicle at a location you provide (home, office, or job site) and dispense fuel into that vehicle. You choose a fueling method (exact gallons, a spend amount, half tank, or full tank), a delivery location, and a delivery window through the app. Orders may cover multiple vehicles in a single request.

Delivery windows, fuel availability, and service areas are estimates and are not guaranteed. We may decline, delay, reschedule, or cancel any order for any reason, including weather, safety conditions, vehicle inaccessibility, or supply issues, and will notify you if we do.

4. Membership, fees, and auto-renewal

FuelExpress offers optional paid membership plans and charges the following standard fees:

  • Non-member fee: $14.95 per order for customers without an active membership, in addition to the cost of fuel delivered.
  • Extra-vehicle fee: $9.95 per additional vehicle on an order beyond what your membership plan includes (or per additional vehicle for non-members), plus the fuel delivered to that vehicle.
  • Emergency / outside-hours orders: available only to active members, subject to the monthly emergency-order limit stated in your plan. Orders placed or scheduled outside normal service hours are automatically treated as emergency orders. Non-members requesting delivery outside normal service hours are charged a flat $75.00 fee in place of emergency service.
  • Weekly fueling limits: membership plans that include a limited number of fuelings per week revert to non-member pricing for any additional order placed within the same week once that limit is reached, unless you upgrade your plan.

Auto-renewal. Membership plans automatically renew at the end of each billing period at the then-current price for your plan, charged to your saved payment method, unless you cancel auto-renewal before the renewal date. You can turn off auto-renewal at any time from your account settings or by contacting us; turning off auto-renewal does not end your membership immediately — you keep your membership benefits through the remainder of the period you already paid for, with no partial refund for the unused portion. Plan upgrades and downgrades take effect at your next renewal date unless stated otherwise in the app.

We may change membership pricing or fees prospectively. If we increase the price of your plan, we will provide notice before it applies to your next renewal, and you may cancel auto-renewal before then to avoid the new price.

5. Payment and authorization holds

All payments are processed by Stripe, a PCI-DSS Level 1 certified payment processor. FuelExpress never receives or stores your full card number; we only receive a tokenized reference and limited details (such as card brand and last four digits) from Stripe.

Because the exact amount of fuel delivered is only known once a driver completes fueling, we place a temporary authorization hold on your payment method when you place an order (for example, approximately $25.00 for a half-tank order or $50.00 for a full-tank order). After delivery, we capture only the actual amount owed based on gallons delivered plus applicable fees, and release or adjust the hold accordingly. You authorize us to charge your payment method for all amounts owed under these Terms, including any reconciliation adjustment if the estimated hold was lower than the final amount.

6. Driver access to your property

By requesting delivery to a specific location, you authorize FuelExpress and its drivers to access that location solely to locate, approach, and fuel the designated vehicle(s). You are responsible for ensuring the vehicle and fuel door are reasonably accessible and for providing accurate gate codes, parking, or access instructions. FuelExpress is not responsible for delays or inability to complete delivery caused by inaccurate or incomplete access information you provide.

7. Prohibited conduct

  • Providing false information about your identity, vehicle, or authorization to order fuel for a vehicle.
  • Requesting delivery to a location you are not authorized to access.
  • Interfering with a driver's ability to safely complete a delivery.
  • Using the Service for any unlawful purpose, or to store or resell delivered fuel in violation of applicable law.
  • Attempting to circumvent fees, membership limits, or security features of the Service.

We may suspend or terminate accounts that violate these Terms.

8. Assumption of risk — fuel is hazardous

Gasoline and diesel fuel are flammable and hazardous materials. FuelExpress drivers are trained and follow safe handling procedures consistent with DOT and NFPA 30A guidance for the transport and dispensing of fuel, and hold the certifications described on our website. You nonetheless acknowledge that fuel delivery and dispensing carry inherent risks, including fire, spill, vapor exposure, and damage to vehicles or property, and you assume these risks to the fullest extent permitted by law when you request delivery. You must ensure your vehicle's fuel system and fuel door are in safe, functioning condition; FuelExpress is not responsible for pre-existing damage or defects in your vehicle's fuel system.

Do not smoke, use open flame, or permit others to do so near a vehicle during fueling. Report any fuel spill, odor, or safety concern to your driver and to us immediately at support@fuelexpressnwa.com.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, FUELEXPRESS DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT DELIVERY WINDOWS WILL BE MET OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FUELEXPRESS AND ITS DRIVERS, OFFICERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.

11. Indemnification

You agree to indemnify and hold FuelExpress harmless from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Service, or inaccurate information you provided about your identity, vehicle, or authorization to request delivery. Drivers who deliver fuel on FuelExpress's behalf do so subject to separate agreements with FuelExpress; nothing in these Terms determines a driver's employment or contractor status, which is governed by those separate agreements.

12. Binding arbitration and class action waiver

Please read this section carefully — it affects your legal rights. You and FuelExpress agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding, individual arbitration administered by a mutually agreed arbitration provider, rather than in court, except that either party may bring an individual claim in small claims court. YOU AND FUELEXPRESS EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION. The arbitrator, not any court, will have exclusive authority to resolve disputes arising under or relating to the interpretation, applicability, or enforceability of this arbitration agreement.

You may opt out of this arbitration agreement by emailing support@fuelexpressnwa.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration.

13. Governing law

These Terms are governed by the laws of the State of Arkansas, without regard to its conflict-of-law principles. For any matter not subject to arbitration, you and FuelExpress consent to the exclusive jurisdiction of the state and federal courts located in Benton County, Arkansas.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (such as an in-app notice or email) before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
